3 reasons you should consider family mediation when separating
Separating from you partner can be an emotionally difficult and daunting time. At a time when emotions are heightened, you then have to have difficult discussions regarding finances and children.
Samantha Lee is a qualified family mediator who says that family mediation can help.
In most cases family mediation takes less time and costs less than court to resolve disputes around financial settlements and child arrangements.
3 reasons why you should consider family mediation:
- You and your ex remain in control of decisions for your family
The mediator is able to offer legal information and help you reach decisions. However, they are unable to make decisions for you or force an outcome. You and your ex discuss issues and reach an agreement together. Decisions and outcomes are not forced on you by a Judge as in court. Only you and your ex know your family and circumstances and are best placed to make decisions for your future. - It can cost less
Family mediation often costs less than court proceedings. It is advised that you each seek legal advice on agreements reached to ensure they are fair. Plus make the agreement legally binding. But you limit the legal costs as you reach the agreement together rather than using litigation to argue your case. You can utilise money for your future such as setting up two homes, caring for any children etc. - Takes less time
Family mediation gives you a neutral environment to have open discussions guided by a mediator. This gives you more time efficiency as you have the flexibility to discuss everything rather than having to apply for separate orders from a court. You can also work to time schedules that suit you and your ex, rather than waiting for space in court timetables and your solicitor’s diary. Agreements reached through family mediation are usually processed through court faster than other alternatives.
Who is family mediation for?
It can be used by anyone – couples, former couples, people who are married or not, those in civil partnerships or same sex relationships, those with children, those without children, people who have decided to separate and those who have already separated.
It is flexible and can include new partners and grandparents if both parties agree.
Plus, children can be consulted if all parties believe it will be helpful. This must be discussed with your mediator first.
What issues can family mediation help with?
Family mediation can help with:
- Immediate plans on separation
- Long term plans for life as separate couple
- Co-parenting
- Child arrangements
- Finances – division of assets and pensions
And much more!
