Head of Family Court wants change

The head of the family court has called for change

the divorce process is old fashioned. Attempts were made to modernise the system a couple of years ago and, yes, the forms became more straightforward and user friendly, but the overall process has not changed. The jargon is still in Latin, which, unsurprisingly, is not spoken by the public at large (or any lawyers).

A Judge still has to look at divorce papers when they are issued and go through proceedings. this leads to rejections for minor errors, such as typing mistakes, which delays the process. Judges are busy creatures and it can take a few weeks before your papers are looked at, rejected, returned, amended, re-sent etc.

Sir James Munby, the head of the family courts, has suggested that the divorce process could become more administrative and that judges could be taken out of the process. This would lead to quicker, more cost effective and more straightforward divorce. This already happens in many countries around the world, and it is about time we updated our systems too.

An argument against making the divorce process easier is that it would undermine the institution of marriage. However, in all our years of practice here at Swain & Co, we can only name a handful of clients who reconciled during the divorce process. We would say that once people have taken that step and decided to divorce, it is unlikely that they will get back together.
