My children have been taken into care – Is it too late to get them back?

When children are taken into Local Authority care and Court proceedings are issued, the Court sets a 26 week timetable for the matter to be dealt with and for the matter to be concluded.

This means that if you are a parent who is a party to care proceedings concerning your children you should take action immediately, without delay, to address the concerns of the Local Authority and to evidence that you are able to care for your children.

It is possible for the Court to extend the 26 week timetable however, they will only do this if it is appropriate and necessary to do so. The Court cannot allow any unnecessary delay as they need to ensure that children have stability and security at the earliest opportunity.  

The Local Authority must consider all possible outcomes for any children subject to care proceedings.

  1. Is it possible for the children to return to the care of either of their parents.?
  2. If this is not possible – what about friends and family?
  3. Should they be placed outside of the family ie long term foster care or adoption.

Due to the very strict 26 week timetable for care proceedings, it is essential that parents take advice quickly.
