Failure to pay ex-wife leads to prison sentence

The Family Court sentenced a husband to four weeks’ imprisonment for failure to pay money due to his wife following court proceedings.

 

The wife had to prove that the husband had the means to pay the money owed and that he had failed to do so.

 

The husband appealed the decision but this was rejected by the Court of Appeal.

 

The husband’s prison sentence was suspended, pending payment within 3 months.

 

The amount he owed in arrears was £320,000.

 

Nicola Whitley, specialist family Solicitor says: “The Court do take failure to pay money very seriously. The only unfortunate part is that it is the burden is on the payee to make an application to the court. If successful, it is likely that costs would be ordered in the payee’s favour, but is still quite unfair that the burden is on the wronged party to make the court application.”
